1. Booking & Payment

A deposit of one-third of the total price is required on the day of booking to secure your spot. The remaining balance will be divided into two further payments:

The second payment is due by August 1, 2025.

The final payment must be completed by October 1, 2025.

Failure to complete payment by these dates may result in the cancellation of your booking without a refund. Payments are non-transferable.

2. Cancellation Policy

- Cancellations made 90 days before departure will receive a 90% refund.  

- Cancellations made within 60 days of the retreat are non-refundable.  

- If the retreat is canceled by the organisers due to unforeseen circumstances, a full refund will be issued. However, we are not responsible for any additional costs, such as flights.  

3. Participant Requirements

Participants must be at least 18 years old. By booking, you confirm that you are physically and mentally capable of participating in the retreat activities.

4. Health and Travel Insurance

All participants are required to have personal travel and health insurance covering medical expenses, accidents, and trip cancellations. The organisers are not responsible for any medical costs incurred during the retreat.

5. Liability Waiver

By joining the retreat, you acknowledge that participation is at your own risk. The organisers are not liable for any injuries, illnesses, or damages incurred during the retreat.

6. Travel Documents & Visas

Participants are responsible for obtaining valid passports, visas, and any required vaccinations. The organisers are not liable for any travel restrictions or denied entries.

7. Photography and Media Consent

By participating, you grant the organisers permission to capture and use photos/videos for promotional purposes. If you do not wish to appear in media content, please notify us in advance.

8. Code of Conduct

Participants are expected to respect fellow attendees, staff, and local communities. Any disruptive behaviour may result in removal from the retreat without a refund.

9. Use of Personal Information

Your personal data will only be used for retreat-related purposes and will not be shared with third parties without consent.

10. Responsibility of Organisers

While we take every precaution to ensure a safe and smooth experience, we are not responsible for unforeseen circumstances, such as natural disasters, political instability, or transportation issues.

11. Accommodation and Room Sharing

Accommodation is based on the package selected at the time of booking. If you prefer a private room, ensure you choose the appropriate package. Room availability is subject to capacity.

12. Transportation and Transfers

Participants must arrange their own flights and airport transfers to the hotel in Nairobi on the first day. On the last day, a car will take the group from Naivasha to Nairobi. Depending on each participant's departure time, they may need to book their own ride, but the organisers will assist with the arrangements. All other transportation during the retreat is included.

13. Activity Participation

All scheduled activities are included in the price, but participants will have the opportunity to choose from a selection of activities curated by the organisers. Groups will be formed based on participant preferences to ensure an enjoyable experience for everyone.

14. Dietary Requirements

All meals will be vegetarian. Please inform us in advance of any allergies or dietary restrictions.

15. Communication and Emergency Contact

Participants must provide an emergency contact prior to the retreat. We will maintain open communication channels for any urgent needs.

16. Force Majeure

The organisers are not liable for cancellations, delays, or changes caused by circumstances beyond our control, such as extreme weather, strikes, or governmental restrictions.

17. Disclaimer

This agreement is governed by and shall be construed according to the laws of Kenya. Nothing in this agreement shall limit or exclude the liability of the organisers for: (a) death or personal injury caused by their direct and substantial negligence, or the direct and substantial negligence of its employees, agents, or subcontractors (as applicable);

(b) fraud, fraudulent misrepresentation, or willful default; and

(c) any matter in respect of which it would be unlawful for the organisers to exclude or restrict liability.

Subject to such provisions and to the extent permissible under applicable law, neither the organisers nor any person acting for, through, or on their behalf shall be liable for any loss or damage whatsoever. This includes, without limitation, direct, indirect, or consequential loss or damage arising from any errors or omissions in any literature, late or non-confirmation or acceptance of bookings, or loss or damage to any property, delays, sickness, personal injury, or death (irrespective of the cause). This does not apply if such liability or claim is a direct and substantial result of the gross negligence or willful misconduct of the organisers.

The organisers may, at their discretion and without liability or cost, cancel or terminate a participant’s booking. This may occur in the event of illness or illegal or incompatible behaviour by the participant, or for any other cause permitted by these terms. In such cases, the participant will not be entitled to a refund.

18. Agreement to Terms

By booking this retreat, you acknowledge that you have read and agree to these Terms and Conditions.

19. VAT and Wellness Classification  

This retreat is organised and sold by Rive Gauche Rhythm-Based Yoga Studio (Copenhagen, Denmark) as a yoga and wellness service. The retreat is offered as a holistic experience focused on yoga, nature, and health-promoting movement. In accordance with Danish VAT legislation, the retreat is not categorised as a package holiday or travel service. All services provided by third-party vendors (accommodation, transportation, guides) are subcontracted, and participants are invoiced only for the overall wellness experience as defined by the retreat program.
